Welcome to Sweetly Sassy Toys. Turbo’s FBC Novelties, LLC, doing business as Sweetly Sassy Toys ("Sweetly Sassy Toys," "we," "us," or "our"), operates this store and website, including the related information, content, features, tools, products, educational materials, workshops, coaching services, and other services offered through the website (collectively, the "Services"). Certain educational and coaching Services may also be offered under The Pleasure Professor brand. Sweetly Sassy Toys is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced within them (collectively, the "Terms"), describe your rights and responsibilities when you access or use the Services. 

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, interacting with, purchasing from, booking through, or otherwise using the Services, you agree to these Terms and our Privacy Policy, available at https://www.sweetlysassy.com/policies/privacy-policy. If you do not agree, you must not access or use the Services.

SECTION 1 - ELIGIBILITY, ACCESS, AND ACCOUNTS

The Services contain adult-oriented sexual wellness products and educational content. You must be at least 18 years old and at least the age of majority in your jurisdiction, whichever is greater, to access or use the Services or purchase any product or service. The Services are not directed to minors, and minors may not access or use them. 

To use certain Services, including purchasing products or booking services, you may be asked to provide information such as your email address and billing, payment, or shipping information. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

We make reasonable efforts to accurately describe and display our products and services. Colors, appearance, packaging, labeling, specifications, ingredients, features, and other details may vary from what appears on your screen or may be changed by a manufacturer without notice. 

We do not guarantee that a product or service will meet every personal expectation or produce a particular result. Individual bodies, preferences, sensitivities, experiences, relationships, and results vary.

Product descriptions are subject to change without notice. We may discontinue products or services and may limit quantities or availability by person, household, geographic region, or jurisdiction.

Always review and follow the manufacturer’s instructions, warnings, ingredients, cleaning guidance, charging directions, storage recommendations, and compatibility information before using a product. Stop using a product and seek appropriate professional guidance if you experience pain, injury, irritation, an allergic reaction, or another concerning response.

SECTION 3 - EDUCATIONAL CONTENT, COACHING, WORKSHOPS, AND DIGITAL MATERIALS

Our articles, videos, product guidance, workshops, classes, coaching sessions, assessments, workbooks, handouts, and other educational materials are provided for general education and personal development. They are not medical diagnosis or treatment, psychotherapy, legal advice, or a substitute for care from a qualified healthcare, mental health, pelvic health, or legal professional.

Participation in educational exercises, discussions, demonstrations, or experiential activities is voluntary. Participants are responsible for communicating their boundaries, obtaining the informed consent of everyone involved, following applicable laws and event rules, and choosing activities that are appropriate for their own bodies, relationships, comfort, and circumstances. No particular personal, relationship, sexual, health, or financial outcome is guaranteed.

Additional attendance, cancellation, transfer, refund, recording, confidentiality, and participation terms disclosed on a workshop, event, consultation, coaching, or booking page also apply. If those specific terms conflict with these general Terms, the terms disclosed for that particular offering will control to the extent of the conflict.

Digital downloads, recordings, workbooks, worksheets, assessments, resource-hub materials, and other educational resources are licensed to the purchaser or registered participant for personal, non-commercial use only. They may not be copied, shared, resold, uploaded, distributed, taught from, published, or used to create derivative commercial materials without our prior written permission.

SECTION 4 - ORDERS

When you place an order, you are making an offer to purchase. We may accept, decline, limit, or cancel an order for any lawful reason. An order is not accepted until we confirm acceptance and successfully process payment.

Please review your order carefully before submitting it. Because orders may be processed quickly, we might not be able to accommodate cancellation or address-change requests after submission. If we decline, change, or cancel an order, we will attempt to notify you using the contact information provided with the order.

You represent that products purchased through the Services are for lawful personal or household use and not for unauthorized commercial resale or export.

SECTION 5 - PRICES AND BILLING

Prices, discounts, product availability, and promotions may change without notice. The amount charged will be the amount displayed when the order or booking is submitted and reflected in the applicable confirmation. Unless stated otherwise, listed prices do not include taxes, shipping, or handling.

We may offer promotions governed by additional terms. If promotional terms conflict with these Terms, the promotional terms control for that promotion.

You agree to provide current, complete, and accurate purchase, payment, and account information and to update it as needed. You represent that you are authorized to use the payment method provided and agree to pay all applicable charges, shipping fees, and taxes.

Charges may appear on your credit card, bank, or PayPal statement under Turbo’s FBC Novelties, LLC, SWTLY SASSY, or another descriptor identified during checkout or by the applicable payment provider.

SECTION 6 - SHIPPING AND DELIVERY

Sweetly Sassy Toys currently ships orders only within the United States. Shipping charges, available methods, and estimated delivery dates are displayed at checkout.

Processing and delivery times are estimates and are not guaranteed. Carrier delays, weather, service disruptions, address errors, and other events outside our reasonable control may affect delivery.

SECTION 7 - INTELLECTUAL PROPERTY

The Services—including our trademarks, brand elements, website text, educational frameworks, assessments, workbooks, worksheets, course materials, graphics, photographs, product reviews, videos, audio, and the selection and arrangement of this content—are owned by or licensed to Sweetly Sassy Toys and are protected by applicable intellectual property laws.

The Terms permit personal, non-commercial use of the Services only. Except where expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, teach from, or commercially exploit any part of the Services without our prior written consent.

Sweetly Sassy Toys, The Pleasure Professor, Pleasure Confidence Series, and our other names, logos, program names, product names, designs, and slogans are trademarks or brand assets of Turbo’s FBC Novelties, LLC or its licensors. Shopify’s names and marks belong to Shopify. Other names and marks belong to their respective owners.

SECTION 8 - OPTIONAL TOOLS

We may provide access to tools, features, or services offered by third parties that we do not control or monitor. These tools are provided "as is" and "as available" without warranties, representations, or endorsement. Your use of third-party tools is at your own risk and is subject to the third party’s terms and policies.

We may add new features, tools, or resources to the Services. Those additions will also be subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain links to, embedded content from, or functionality provided by third parties. We are not responsible for evaluating or guaranteeing the accuracy, availability, legality, security, or practices of third-party materials, websites, products, or services.

If you leave the Services or interact with a third party, you do so at your own risk. Review the third party’s terms, privacy practices, and policies before completing a transaction or providing information. Questions or disputes regarding third-party products or services should be directed to that third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Sweetly Sassy Toys is powered by Shopify, which enables us to provide the Services to you. However, purchases from our store are made directly with Sweetly Sassy Toys. Shopify is not responsible for any aspect of sales between you and Sweetly Sassy Toys, including any injury, damage, or loss resulting from purchased products or services. To the extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to your purchases and transactions with Sweetly Sassy Toys. 

SECTION 11 - PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy at https://www.sweetlysassy.com/policies/privacy-policy. Certain information may also be subject to Shopify’s Privacy Policy at https://www.shopify.com/legal/privacy/app-users.

Because Shopify hosts the Services, Shopify processes information about your access to and use of the Services to provide and improve the platform. Information may also be shared with service providers and processed in countries other than the country where you reside, as explained in the applicable privacy policies.

SECTION 12 - FEEDBACK AND REVIEWS

If you submit ideas, suggestions, feedback, reviews, proposals, plans, photographs, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display the Feedback for lawful purposes, including operating, improving, and promoting the Services.

You represent that you own or have permission to submit the Feedback, that you have disclosed any compensation or incentive connected with it, and that it does not violate another person’s intellectual property, privacy, publicity, or other rights. You are responsible for the accuracy and legality of your Feedback.

We have no obligation to keep Feedback confidential, compensate you for it, or respond to it. We may monitor, edit, decline, or remove Feedback that we believe is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, offers, shipping charges, transit times, availability, educational content, or other information. We may correct errors, update information, or cancel affected orders when permitted by law, including after an order has been submitted.

You may use the Services only for lawful purposes. You may not use them to violate laws or regulations; infringe intellectual property or privacy rights; harass, abuse, defame, threaten, or harm another person; transmit false or misleading information; send spam or unauthorized solicitations; impersonate another person or entity; upload malicious code; interfere with security or functionality; collect another person’s information without authorization; or engage in conduct that restricts another person’s use of the Services or exposes Sweetly Sassy Toys, Shopify, or others to liability.

You may not reproduce, duplicate, copy, extract, sell, resell, scrape, data-mine, or commercially exploit any portion of the Services without authorization. You may not use robots, spiders, automated extraction tools, or AI agents to access the Services in violation of our technical controls, posted instructions, or these Terms.

We may suspend or terminate access if we reasonably determine that these Terms have been violated. 

SECTION 15 - AUTOMATED AGENTS

This section applies if you deploy or enable software that takes autonomous or semi-autonomous actions on behalf of a person or entity (an "Agent") to access or interact with the Services.

An Agent may not access or interact with the Services if we have requested that it stop or if access is prohibited by our technical controls or posted instructions. We may limit whether and how Agents access the Services.

Any permitted Agent must identify itself accurately, must not conceal or misrepresent that it is automated, must respond truthfully to prompts intended to distinguish computers from humans, and must not circumvent CAPTCHAs, access controls, robot exclusions, or other measures designed to restrict automated access.

SECTION 16 - TERMINATION

We may terminate these Terms or suspend or terminate your access to all or part of the Services in our reasonable discretion, including when we believe you have violated these Terms. You remain responsible for amounts owed through the date of termination.

Provisions that by their nature should survive termination will remain effective, including provisions addressing intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law, and privacy.

SECTION 17 - DISCLAIMER OF WARRANTIES

Information provided through the Services is offered for general informational and educational purposes. We do not warrant that it is complete, current, or suitable for every person or circumstance. Reliance on this information is at your own risk.

EXCEPT AS EXPRESSLY STATED BY SWEETLY SASSY TOYS AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR PROHIBIT CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

Nothing in these Terms limits any warranty, remedy, or consumer right that cannot lawfully be excluded.

SECTION 18 - LIMITATION OF LIABILITY 

TO THE FULLEST EXTENT PERMITTED BY LAW, SWEETLY SASSY TOYS, TURBO’S FBC NOVELTIES, LLC, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS OBTAINED THROUGH THEM, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICES OR A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the fullest extent permitted by law.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Sweetly Sassy Toys, Turbo’s FBC Novelties, LLC, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from your material breach of these Terms, violation of applicable law, infringement of another person’s rights, or misuse of the Services.

We will provide reasonable notice of an indemnifiable claim when practicable. We may control the defense and settlement of the claim at your expense, but we will not agree to a settlement that imposes a non-monetary obligation on you without your consent, which will not be unreasonably withheld.

SECTION 20 - SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest lawful extent or severed as necessary. The remaining provisions will continue in effect.

SECTION 21 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms is not a waiver of that right.

These Terms and the policies or offering-specific terms incorporated by reference constitute the entire agreement regarding your use of the Services and supersede prior or contemporaneous agreements and communications concerning that subject, except for a separate written agreement signed by the applicable parties.

 Any ambiguity in these Terms will not automatically be construed against the drafting party.

SECTION 22 - ASSIGNMENT

You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our prior written consent. We may assign or transfer these Terms and our rights or obligations as permitted by law.

SECTION 23 - GOVERNING LAW AND VENUE

These Terms and any separate agreements through which we provide Services are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.

To the extent a dispute may lawfully be resolved in court and the parties have not agreed in a separate written agreement to another method of dispute resolution, the parties consent to the personal jurisdiction and venue of the state courts located in Franklin County, Ohio, and the applicable federal court serving Franklin County, Ohio.

Headings are included for convenience only and do not limit or affect these Terms. 

SECTION 25 - CHANGES TO THESE TERMS

The current version of these Terms is available on this page. We may update these Terms by posting a revised version and changing the "Last updated" date. When required by law, we will provide additional notice of material changes. Continued use of the Services after the effective date of revised Terms constitutes acceptance of those revisions.
